Maternity protection expanded to also cover miscarriages

On 30 January 2025, the German parliament passed the Maternity Rights Amendment Act (Mutterschutzanpassungsgesetz) to change the Maternity Rights Act (Mutterschutzgesetz) to introduce staggered maternity protection periods (that is, the right to paid leave). With the amendment, women who experience a miscarriage from the 13th week of pregnancy will receive two weeks of maternity protection, increasing to six weeks after the 16th week and eight weeks after the 19th week. Currently, the Maternity Rights Act provides maternity protection from six weeks before until eight weeks after the expected birth. The amendment will come into effect on 1 June 2025.
